These terms and conditions are also attached to your formal quotation. By placing your order you agree to these terms and conditions and a contract is formed between you and Zoe Barker Design. We request written confirmation that you would like to place an order. This can be supplied by email.
Design & Copy Right
For the Your Story design option: Your moodboard may not contain original drawings but it will showcase examples of colours, styles and techniques. Following feedback from your moodboard I provide reasonable amends until you are happy. Reasonable amends include up to 3 sets of amends to your first draft design. This equates to 3 digital PDF proofs at low resolution or watermarked to protect our intellectual property. It is at my discretion to charge a nominal fee for any additional proofs requested.
For the Portfolio design package: You agree to using the existing design format with customisation. I provide 2 sets of amends, which equates to 2 PDF proofs at low resolution or watermarked to protect our intellectual property. It is at my discretion to charge a nominal fee for any additional proofs requested. (the same terms apply to the Portfolio Plus design Package).
Bespoke Design: If your brief changes dramatically and requires a re-design or re-draw during any part of the design and print process we reserve the right to stop work and revise our quotation and/or invoice. I will charge at an hourly rate of £30 per hour for any re-design, re-painting or new illustration work required following amends to the first design draft. Additional drawings in line with your original brief are included in your existing quotation.
Print: Sometimes, colours on screen can differ to the printed item. I offer printed proofs for a nominal fee on request and cannot be held responsible for re-prints due to colour differences. If the original material is not available at time of print we reserve the right to replace with a material of same quality and best match. We will always inform the client if this occurs.
Copyright: All designs and illustrations are copyright of Zoe Barker Design and can be used in portfolios or re-worked for new designs. I will not re-create bespoke designs but copyright remains with Zoe Barker Design. To protect livelihood and maintain authenticity and quality of design work I ask that no designs be replicated, re-used, copied or edited in any way.
Digital Files: I do not send any digital or editable artwork or design files. A release fee is applicable if you require original artwork files to re-create printed items or replicate designs and will be imposed if my design is found to have been replicated in any way. This release fee is in place to protect the livelihood and integrity of Zoe Barker Design
Quotations are valid for 14 days from date of issue, we will notify you of any changes in price or product if this date is exceeded when you place your order. Your invoice will be sent directly and payment is required on receipt and before work commences. 50% non-refundable deposit is accepted for orders over £500. For orders under £500 payment must be made in full. Payment of your invoice secures a design slot in line with your required date and our availability. We request acceptance of your order in writing by email. By accepting our quotation and placing your order you agree to our terms and conditions. Payment should be made to Zoe McCarthy, Lloyds Bank, sc: 30-90-85 acc: 01000032. Final balance of your invoice is due before the last day of the month proceeding your allocated print month. Your printed items will be allocated for print upon placing your order in line with availability and schedule. Should this allotted time move the invoice is still payable as per the payment terms.
Postage & Packaging
Postage and packaging is charged per dispatch and is calculated using size and weight of parcel. We can deliver both nationally and internationally and prices are quoted individually. We offer standard, tracked and guaranteed delivery but cannot be held responsible for the loss or damage of any parcels that have been sent by standard post without tracking. If you order online we will use ParcelForce 48hr Service or an alternative service of same guarantee and cover.
Refunds & Exchanges
All work is bespoke by nature and as such we don’t offer refunds on products or design time. All items are quality checked before they are forwarded on to the client. Should we have any problems with stock quoted we reserve the right to source an alternative like for like product.
If there is any reason that I cannot fulfil your order I will arrange for a trusted colleague or supplier to liaise with you and complete your work at no extra cost to you. If this is impossible to arrange I will arrange a refund on any works not undertaken. We reserve the right to cancel your order if we receive abusive or threatening communication directly or indirectly and your any monies paid will be non-refundable. If your demands exceed your agreed quotation we reserve the right to cancel our agreement and cease working on your order. If you require additional work we will provide a quotation and stop all works until an agreement has been made on direction and action. Our hourly rate is £30 per hour and will be charged accordingly at our discretion. Should we have any problems with our outsourced stock quoted we reserve the right to source an alternative like for like product.
It is your responsibility to provide time sensitive information within the agreed timescale. We cannot be held responsible for any delay to print and delivery caused by late provision of information including feedback on proofs and amends to copy or design. Payment must be made in full before print and delivery can be arranged regardless of agreed delivery timeframe. It is at our discretion to withhold designs until balance is cleared. Although we will guide you with regards to timeframe and deadlines we cannot be held responsible for delays to design or print due to any delay in communication or provision of information. Timescales are estimated and depend on scope of project and availability. We aim to order the print of your items within 48 hours of your approved final proof. We are not able to adjust print orders once your final proof has been approved and quantities confirmed. We aim to return any amends to copy and layout within 72 hours.
Orders placed within 1 month of the required date or wedding date are classed as short notice or rush jobs and may incur an additional fee. Lead times for rush jobs will be detailed on an individual basis. Items printed at short notice will be sent directly from the printer to the client and as such we cannot be held responsible for any errors in print or delays to delivery that are out of our control. By placing a rush job order you agree to the non-refundable fee and understand that we cannot be held responsible for any quality issues or print errors nor can we organise a re-print or a refund at such short notice.
